New and Used Equipment Terms and Conditions of Sale<\/span><\/h1>\n

\u00a0<\/p>\n

The foregoing items are sold \u201cas is\u201d and \u201cwhere is\u201d. RocxGroup, LLC (dba Rocxquip Equipment Sales) warrants title only.<\/span><\/p>\n

There are no other warranties, express or implied including, without limitation, as to merchantability or fitness for a particular<\/span><\/p>\n

purpose. All such warranties are expressly disclaimed. RocxGroup, LLC (dba Rocxquip Equipment Sales) shall not be liable,<\/span><\/p>\n

whether as a result of breach of contract, warranty, liability in tort including or otherwise, for indirect, incidental, special,<\/span><\/p>\n

punitive, consequential damages, including, without limitation, loss of profit, revenues or goodwill, loss of use of equipment,<\/span><\/p>\n

cost of capital, cost of substitute equipment or services, or downtime costs, even if such damages were foreseeable and even<\/span><\/p>\n

if seller was advised of the possibility of such damages. Both RocxGroup, LLC (dba Rocxquip Equipment Sales) and Purchaser<\/span><\/p>\n

expressly agree that the foregoing limitations are agreed allocations of risk constituting in part the consideration for this sale.<\/span><\/p>\n

Purchaser and RocxGroup, LLC (dba Rocxquip Equipment Sales) agree to all of the foregoing.<\/span><\/p>\n
